You might be licking your own wounds, while worrying about your children. You may be wondering how to protect your hard-earned property and you have no idea how to proceed.
Perhaps you have heard that you must contact an attorney. Maybe you have even already tried to litigate these matters, and after spending thousands of dollars and many months, you still don’t have a resolution. Litigation can drag on, and you feel like you are on a roller coaster of emotions. There are many calls to and from your attorney; and both you and your ex are consumed with your “case.”

Mediation: An Overview
If you and your spouse (or partner) are willing to work through the details of your separation and arrive at a reasonable solution for your family or about your property, then Sirera Mediation Services could work for you.
What Is Mediation?
Mediation provides an alternative means of dispute settlement to lengthy litigation proceedings. Participation in mediation must be entered into voluntarily by both or all parties involved and is generally conducted in a neutral, nonthreatening environment where each party is able to effectively negotiate and reach a mutually satisfactory agreement. Mediation sessions are facilitated by a trained and Qualified Custody and Visitation Family Law Mediator, listed on the Custody and Visitation Mediators Registry with the Louisiana State Bar, who allows each party to address his or her concerns and reach an effective agreement.
How Can Mediation Help Me?
When family law issues are highly contentious, the individuals involved sometime lose control of the outcome. Lengthy courtroom proceedings increase the expenses of a divorce, and decision-making can get handed over to a judge or hearing officer who does not know you or your family.
Mediation gives individuals who are able to come to reasonable agreements the opportunity to do so without handing over control of their family law disputes to a judge. This avoids the excessive fees and time associated with courtroom proceedings, and more importantly, it allows parents to be in charge of the decisions about what is right for their family, and individuals to be in charge of decisions about their own property.
What Are The Steps Of Mediation In Family Law And Divorce Proceedings?
For your family law disputes such as, use of the house, custody, community property partition, child support or spousal support the specific process will depend on the different issues that your family must work through.
A trained, qualified mediator from Sirera Mediation Services will meet with you and the opposing party to go over each of the issues that must be considered in your family law dispute. If necessary, to avoid emotional conflicts by separating each party into separate breakout rooms, he or she will do so. When areas of dispute arise, she will remain focused on negotiating worthwhile settlements so that each party comes out of the situation with a confident outlook on the future.
Nuts & Bolts
Mediation sessions are $395.00 per hour, with a two-hour minimum and a one-time $350.00 case management fee. When a Mediation session is scheduled, the parties will be provided with an introductory packet, as well as an Agreement to Mediate, which must be signed by both parties prior to the first Mediation Session. You will be instructed as to what documents to bring with you, depending on what issues you and your former partner wish to Mediate.
Some people are able to mediate all issues in that initial mediation session others need to schedule further sessions. We work with you and your schedule to promptly arrange your next session(s), if necessary.
After a successful Mediation, the Mediator will draft a Memorandum of Understanding for all to sign (Mediator, and all parties), which outlines the agreements which were made in the Mediation. The Memorandum of Understanding is used by an Attorney for either party to draft a document to be filed with the Court, which makes the agreements a Judgment of the Court, and legally-binding. As a courtesy to our clients, Sirera Mediation Services has compiled a list of attorneys who are familiar with the mediation process and who have agreed to draft necessary legal documents for a reasonable flat fee
